Compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (PoSH Act) has become non-negotiable for all the organisations across the country. In a landmark Supreme Court ruling has made it mandatory for organization to register on the SHe-Box Portal, an online platform launched by the Ministry of Women and Child Development (MWCD) for efficiently handling, monitoring, and resolution of sexual harassment cases at workplaces. Registration on SHe-Box will ensure seamless complaint management and also demonstrates organisation’s commitment to employee well-being.
Is it mandatory to register on SHe-Box?
Yes, it is mandatory for all the organisations with 10 or more employees to register on the government portal. SHe-Box portal is a central governed portal that will empower women for a secure chanel for filing the complaint and also keep records of the sexual harassment cases across the nation. It is pertinent to mention that under the new rules of the Ministry of Corporate Affairs it is mandatory to disclose the PoSH. Non-compliant with the PoSH Act will constitute a violation of law which makes the director accountable for penalties of Rs. 50,000/- on each director from the date of non-compliance and further non-compliance leads to penal punishment for every director.
Prerequisites for Registration
For registration ensure that organisation has comply with the rules of PoSH Act,2013:
- Constitution of the Internal Committee as per section 4 of the Act every organisation with 10 or more employees shall form an Internal Committee having a senior female employee as the presiding officer and an external member working for the empowerment of women. It is important to have 50% female employees as other members.
- Appointment of Nodal officer: Any senior employee of the organisation can be appointed as nodal officer. The nodal officer will be responsible for portal interaction, document submission and other compliances.
- Documents: Assemble organisation’s incorporation certificate, PAN Card, or any other address proof, IC members detail along with contact details, PoSH Policy, and official email id for verification and further communication.
Steps For registration
- Visit the SHe-Box Portal “shebox.mowcd.gov.in.”
- Click on the tab private head office registration, this will lead to the application page mentioning the required details of the organisation and proceed with the OTP verification.
- After the verification fill the organisation name, address, employee strength, IC and Nodal officer details
- Review all entries, then submit. Will receive a confirmation email from the department.
Verification and Activation
After the submission the District Nodal officer will verify the details submitted by the organisation, if satisfied then assign a permanent login credentials for using the portal. By login the organisation registration certificate can be downloaded for organisation internal records.
Post-Registration Obligations
- Update the IC details: If there is any change in IC constitution update the same earliest.
- Annual PoSH Report Submission: Every year submit the PoSH annual report to the district officer and disclose the same on the portal
- Awareness training sessions: Conduct training sessions regularly for the employees.
- Confidentiality: Maintain confidentiality while handling the PoSH complaints.
Challenges faced while registration
- Technical issues: The portal may show “module under maintenance”. Try after a few hours or use an alternate browser for the same.
- For Multi-Branch Organisations: Register the head office first, then add branches through the dashboard to avoid duplicates.
